1. GENERAL / SCOPE OF APPLICATION

These terms and conditions apply to all types of orders. Deviating or additional provisions, as well as agreements or oral conditions of the buyer, are recognized only if confirmed in writing by Lovingreen.

2. DELIVERY AND SHIPPING COSTS

Delivery takes place in Switzerland, the Principality of Liechtenstein, and the countries of the European Union. As a shipping partner, Lovingreen works with Swiss Post as the shipping service provider in Switzerland. If one or more items are not available in stock and have not been marked as “out of stock” in the online shop, the customer will be notified and the goods will either be delivered as soon as possible or fully refunded. Shipping is usually processed from Monday to Friday by 6:00 p.m. and dispatched on the same day. Public holidays are excluded.

Lovingreen hands over the parcels to Post AG. Lovingreen cannot be held responsible for delivery delays caused by Post AG (traffic congestion, bad weather, delivery issues). Lovingreen strives to deliver the goods as quickly as possible; in the event of delays, Lovingreen may be contacted as an intermediary between the customer and Post AG. Lovingreen ships with “Priority PostPac.” Shipping usually takes place by 6:00 p.m. on the working day. The shipping time until delivery is one working day.

Shipping costs are calculated as follows:

• Free shipping for orders over CHF 120.00
• Shipping costs up to CHF 119.99: CHF 7 per order

3. PRICES, DISCOUNTS AND PAYMENT

All prices are stated in Swiss francs (CHF) and include the statutory value-added tax. Lovingreen reserves the right to change or adjust prices and discounts at any time without prior notice. The price valid at the time the contract is concluded shall apply. Payment for the order is made by credit card (Visa, Mastercard, American Express), Twint, or PayPal, and we will confirm receipt of payment with the order confirmation.

4. WARRANTY PROVISIONS

The statutory warranties apply to the products listed in the catalogue.

5. PRODUCT IMAGES AND DESCRIPTIONS

Lovingreen strives to display always up-to-date product images. In some cases, there may be differences between the product images and the actual product. Product descriptions may be derived from the original product texts. The product descriptions are truthfully paraphrased according to the motto “authenticity to convey” and after conducting our own tests.

6. DISCLAIMER / EXCLUSION OF LIABILITY

Lovingreen assumes no liability for any kind of loss or damage. This also excludes consequential, direct, and indirect damages.

7. LIABILITY

Lovingreen is responsible for any damage to products caused during transportation, including products not delivered by Post AG (lost packages). To invoke this responsibility, tracking and traceability through Post AG is considered a reasonable indication of loss or damage.

8. RIGHT OF WITHDRAWAL

For orders placed through the sales channels referred to in Section 1, we grant a right of withdrawal. The withdrawal must always be made in writing, either by letter or email to Lovingreen, within 14 days of receiving the goods. The delivery date or the date of delivery to Post AG shall be decisive for meeting the deadline.

By exercising the right of withdrawal, the purchase contract is converted into a return arrangement, after which the items received under the purchase contract must be refunded. In the event of withdrawal, the purchaser is obliged to return the goods immediately and in their original packaging to Lovingreen. As a rule, return shipping costs are borne by the customer. Upon receipt of the goods, we will promptly carry out an inspection and refund the purchase price of the item. We reserve the right to deduct an amount from the refundable purchase price in the case of damaged goods or excessive wear.

9 COPYRIGHT

We reserve the copyright and exclusive use. This applies to platforms such as online stores, social media channels, or advertising measures managed by Lovingreen. The content, texts, and illustrations are protected by copyright, unless they are owned by third parties. Copying texts and illustrations requires written consent.

10. DATA PROTECTION

Lovingreen is committed to preserving data and obligations. The data protection regulation under Swiss law applies.

11 APPLICABLE LAW AND JURISDICTION

Swiss law (Swiss Code of Obligations) applies exclusively. The place of performance for both contracting parties is Lugano.
